Budnik Wheels Inc. ("Budnik," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect when you visit budnik.com (the "Site"), place an order, contact us, or interact with our advertising, how we use that information, who we share it with, and the choices and rights available to you.

By using the Site you agree to the practices described here. If you do not agree, please discontinue use of the Site.

1. Information we collect

Information you provide directly

• Order and transaction information: name, billing and shipping address, email address, phone number, order contents, and order history.
• Payment information: payment card details are collected and processed by our payment processors. Budnik does not store full payment card numbers on its own systems.
• Account information: if you create an account, your email address, password, saved addresses, and saved preferences.
• Custom build and fitment details: vehicle year, make, model, wheel specifications, finish selections, offsets, bolt patterns, photographs, and other information you submit so we can quote or manufacture a custom product.
• Customer service and warranty information: the content of emails, phone calls, chat sessions, warranty claims, and return or repair requests, including any photographs or documents you send us.
• Dealer, distributor, and installer information: business name, contact person, resale certificate or tax identification details, and credit application information when you apply for a wholesale or dealer account.
• Marketing sign-up information: email address, mobile phone number, and any preferences you provide when subscribing.

Information collected automatically

• Device and connection data: IP address, browser type and version, operating system, device identifiers, screen resolution, and language settings.
• Usage data: pages viewed, products viewed, time spent on pages, referring and exit URLs, search terms entered on the Site, items added to cart, and click activity.
• Cookie and pixel data: identifiers set by us and by the third parties described in Section 5.
• Approximate location: derived from your IP address, used for tax calculation, shipping estimates, fraud screening, and regional content.

Information we do not intentionally collect

We do not seek to collect government identification numbers, biometric data, precise geolocation, health information, or information about racial or ethnic origin, religious beliefs, sexual orientation, or union membership. Please do not send this information to us.

2. Where the information comes from

We obtain personal information from you directly, automatically through your use of the Site, and from third parties including our ecommerce platform, payment processors, shipping carriers, fraud prevention providers, advertising platforms, and social media services where you interact with our pages or ads.

3. How we use your information

• Process, fulfill, manufacture, ship, and track your orders, including custom wheel builds.
• Communicate with you about orders, quotes, production status, backorders, returns, warranty claims, and support requests.
• Create and administer accounts and dealer relationships.
• Verify identity, screen for fraud, prevent abuse, and secure the Site.
• Calculate taxes, duties, and shipping charges.
• Send marketing communications where you have subscribed or where permitted by law.
• Personalize the Site, remember your cart, and recommend products.
• Measure and improve the performance of our advertising, including retargeting and lookalike audience creation.
• Analyze site traffic, product demand, and customer trends so we can improve our products and service.
• Comply with legal obligations including tax, accounting, export, product safety, and recordkeeping requirements.
• Establish, exercise, or defend legal claims.

4. Cookies and tracking technologies

Cookies are small text files placed on your device. We and our partners also use pixels, web beacons, software development kits, and local storage. We use them in the following categories.

Most browsers let you refuse or delete cookies through their settings. Blocking strictly necessary cookies will prevent parts of the Site, including checkout, from working.

Global Privacy Control and Do Not Track

We honor the Global Privacy Control (GPC) signal as a valid request to opt out of the sale or sharing of personal information for the browser and device that sends it. Browser "Do Not Track" signals have no uniform standard, and we do not respond to them separately.

5. Advertising and analytics partners

We use third-party advertising and analytics services that set their own cookies and identifiers on the Site and receive information about your activity. These currently include:

• Meta (Facebook and Instagram) through the Meta Pixel and Conversions API.
• Google through Google Analytics, Google Ads, and Google Tag Manager.
• TikTok through the TikTok Pixel and Events API.

These partners may combine the information they receive from the Site with information they already hold about you in order to show you Budnik ads elsewhere and to measure whether those ads led to a purchase. Under California and several other state privacy laws, this activity is treated as "sharing" for cross-context behavioral advertising, and in some cases as a "sale" of personal information. You can opt out as described in Section 8.

You can also manage interest-based advertising directly through industry tools at optout.aboutads.info and optout.networkadvertising.org, and in the ad settings of each platform account.

6. How we disclose information

We do not sell your personal information for money. We disclose personal information in the following circumstances.

• Service providers. Ecommerce and hosting platforms, payment processors, fraud prevention services, shipping and freight carriers, email and SMS platforms, customer support tools, and accounting providers. They are permitted to use the information only to perform services for us.
• Advertising and analytics partners. As described in Section 5.
• Dealers and installers. When you request that an order be shipped to or coordinated through a dealer or installer, we share the information needed to complete that arrangement.
• Legal and safety. When required by subpoena, court order, or law, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
• Corporate transactions. In connection with a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred to the successor entity.
• With your direction. Any other disclosure you request or consent to.

7. Email and SMS marketing

If you subscribe, we send promotional emails about new products, releases, and offers. Every marketing email includes an unsubscribe link. Unsubscribing from marketing does not stop transactional messages such as order confirmations and shipping notices.

If you opt in to SMS or text marketing, you consent to receive recurring automated marketing text messages at the mobile number you provide. Consent is not a condition of purchase. Message and data rates may apply, and message frequency varies. Reply STOP to any message to opt out and HELP for assistance. We share your mobile number with the SMS platform that delivers the messages on our behalf, and we do not sell mobile numbers or SMS consent information to third parties for their own marketing.

8. California privacy rights (CCPA/CPRA)

This section applies to California residents. In the preceding twelve months we have collected the categories of personal information listed below.

We collect these categories for the business and commercial purposes described in Section 3, from the sources described in Section 2, and disclose them to the categories of recipients described in Section 6. We do not knowingly collect or process sensitive personal information for the purpose of inferring characteristics about you.

Your California rights

• Right to know the categories and specific pieces of personal information we have collected, the sources, our purposes, and the categories of third parties involved.
• Right to delete personal information we have collected from you, subject to exceptions such as completing a transaction, warranty obligations, security, and legal compliance.
• Right to correct inaccurate personal information.
• Right to opt out of the sale or sharing of personal information for cross-context behavioral advertising.
• Right to limit the use of sensitive personal information, to the extent we process any.
• Right to non-discrimination for exercising any of these rights. We will not deny you goods or services, charge different prices, or provide a different quality of service because you exercised a right.

How to exercise your rights

Email Support@budnik.com with the subject line "Privacy Request" and tell us which right you wish to exercise, or write to us at the address in Section 16. To opt out of sale and sharing, you may also enable Global Privacy Control in your browser or use the cookie preference controls on the Site.

We will verify your request by matching the information you provide against the information in our records, and we may ask for additional information if we cannot verify your identity. An authorized agent may submit a request on your behalf with written permission from you and proof of their authority. We respond to verifiable requests within 45 days and may extend that period by an additional 45 days with notice to you.

9. Other U.S. state privacy rights

Residents of Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, among other states with comprehensive privacy laws in effect, have rights to confirm whether we process their personal data, access it, correct it, delete it, obtain a portable copy, and opt out of targeted advertising, sale, and certain profiling. Use the same contact method described in Section 8.

If we deny your request, you may appeal by replying to our decision with the subject line "Privacy Appeal." We will respond to the appeal in writing within 45 days. If the appeal is denied, you may contact your state attorney general.

Nevada residents may submit a verified request that we not sell certain covered information by emailing Support@budnik.com.

10. EU, UK, and international users (GDPR)

Budnik Wheels Inc. ships internationally. If you are located in the European Economic Area, the United Kingdom, or Switzerland, this section applies to you and Budnik Wheels Inc. acts as the controller of your personal data.

Legal bases for processing

Your rights

You have the right to access your personal data, correct inaccurate data, request erasure, restrict or object to processing, receive your data in a portable format, and withdraw consent at any time without affecting processing carried out before withdrawal. Where processing relies on legitimate interests, you may object on grounds relating to your particular situation.

To exercise these rights, email Support@budnik.com. We respond within one month and may extend that period by two further months for complex requests. You also have the right to lodge a complaint with your local supervisory authority, or with the Information Commissioner's Office in the United Kingdom.

International transfers

We are based in the United States, and personal data we collect is transferred to and processed in the United States and other countries where our service providers operate. These countries may not offer the same level of data protection as your home country. Where we transfer personal data out of the EEA or the UK, we rely on appropriate safeguards including the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum. You may request a copy of the safeguards we use by contacting us.

11. Data retention

We keep personal information for as long as needed to fulfill the purposes described in this policy. Order and transaction records are retained for at least seven years to meet tax, accounting, and warranty obligations. Account information is retained while your account is active. Marketing contact information is retained until you unsubscribe and for a reasonable period afterward to honor your opt out. Site analytics and advertising data are retained according to each platform's standard retention window. When information is no longer needed, we delete it or de-identify it.

12. Security

We use administrative, technical, and physical safeguards designed to protect personal information, including TLS encryption in transit, access controls, and payment processing through PCI-DSS compliant providers. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account password confidential.

13. Children's privacy

The Site is intended for adults. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us personal information, contact Support@budnik.com and we will delete it.

14. Third-party links

The Site may link to dealer sites, social media pages, and other third-party services. We do not control those sites and are not responsible for their privacy practices. Review their policies before providing information.

15. Changes to this policy

We may update this Privacy Policy at any time. The revised version takes effect when posted, and the "Last updated" date at the top will reflect the change. If we make material changes, we will provide additional notice such as an email or a notice on the Site. Continued use of the Site after a change means you accept the revised policy.
